BADDIES ONLY GIVEAWAYS RULES

These Rules govern the offering and conduct of Giveaways available on Baddiesafterdark.com and other websites or mobile applications operated by Baddie Enterprises LLC. and its affiliates (collectively, "Baddies Only", "we" or "us"). These Rules form a part of the Baddies Only Terms and Conditions. Capitalized terms not defined in these Rules have the meaning ascribed to them in those Terms.
Giveaways are open only to legal residents of the United States, Canada, the United Kingdom, European Economic Area and Switzerland who are of eligible age to participate in their jurisdiction and at least 18 years of age. Void where prohibited. Employees (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of BADDIES ONLY, or its affiliates and advertising and promotion agencies, are not eligible to enter or win. Giveaways are subject to all applicable laws.
1. No Purchase Necessary
No purchase is necessary to participate in any Giveaway. Membership is also not required. There are two ways to enter the Giveaways: (1) through Membership in the Service; and (2) on a 3" x 5" piece of paper, hand-print your name, complete address, daytime and evening telephone numbers (area code included), and date-of-birth, and mail entry in a properly stamped #10 envelope to: BADDIES ONLY GIVEAWAYS, 6709 Selma Ave. Los Angeles CA 90028
Participation in a Giveaway requires that we collect, store, use, share and otherwise process personal information of participants. To learn what kinds of personal information we process along with why, how and where we process it, please read our Privacy Policy. It will also provide useful information about the rights participants may have in relation to their personal information and how they may be able to exercise such rights.
Limit one (1) Membership or mail-in entry per person, per email address for each monthly Giveaway, regardless of method of entry. Multiple entries received from any person or e-mail address after the first entry received from that person or email address will be void. All mail-in entries must be mailed in separately. Entries generated by script, macro or other automated means or means which subvert the entry process will be void. All entries become the property of BADDIES ONLY and will not be acknowledged or returned.
2. Selection and Agreement of Winners
Potential winners will be selected in a random drawing held monthly from all eligible entries received for applicable drawing, including all active Memberships. Entries for a particular monthly drawing do not roll over to the following month’s drawing. Odds of winning depend on the number of eligible entries received.
Potential winners will be notified by mail, phone or e-mail and may be required to execute and return an affidavit of eligibility, and, where permitted under applicable law, a liability and a publicity release within seven (7) days of date of issuance. A parent or legal guardian will be required to execute and return these documents if the participant is a minor in the relevant country. If: (a) such documents are not returned within the specified time period; (b) a prize or prize notification is returned as undeliverable; (c) BADDIES ONLY is unable to contact a potential winner; or (d) a potential winner is not in compliance with these Rules, the prize will be forfeited and, at BADDIES ONLY’s sole discretion, an alternate winner selected.
Each winner, by acceptance of a prize, except if legally prohibited in the relevant country, grants permission (or, if a minor, the parent or legal guardian grants permission on the winner’s behalf) for BADDIES ONLY and its designees to use, to the extent permissible in the winner’s country, his/her name, address (city and state), [photograph, voice and other likeness] and prize information for advertising, trade and promotional purposes without further compensation, in all media (including digital media) now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval.
3. Prizes
Approximate Retail Value ("ARV") of Prizes is $0-$50,000 (U.S. dollars). Total ARV of all prizes can be found here. Prizes are awarded "as is" with no warranty or guarantee, either express or implied, by BADDIES ONLY. Winners may not substitute, assign or transfer prize or redeem prize for cash, but BADDIES ONLY reserves the right, at its sole discretion, to substitute any prize (or portion thereof) with one of comparable or greater value. Winners are responsible, to the fullest extent permitted by applicable law, for all applicable taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. Selection and method of redemption or distribution of prizes are at BADDIES ONLY’s sole discretion.
Sponsor may offer, from time to time, different prizes for different contests. Each contest page will contain additional information about the prize offered. Generally, those prizes may include:
TRAVEL PRIZES: Destination, dates, number of guests (if any), number of days and nights for accommodations (if applicable), and approximate retail value to be specified on the individual contestpage. Travel prizes include a trip for winner and,if applicable, guest(s), to a destination on dates to be determined by Sponsor. Trip consists of roundtrip, coach class air transportation from a major U.S. gateway airport nearest winner’s residence to the designated location and standard hotel accommodations (one room, double occupancy) for the specified number of days and specified number of nights If a car rental is provided ,car rental is for the duration specified in the individual contest and is subject to car rental company terms and conditions. If winner resides within a 100-mile radius of destination, ground transportation will be provided in lieu of air transportation and no compensation or substitution will be provided in lieu thereof. Actual value of prize may vary based on point of departure. Any difference between stated value and actual value will not be awarded. Trip must be taken on dates specified by Sponsor or prize will be forfeited and Sponsor will have no further obligation to such winner. Sponsor reserves right to change dates. Winner and guest(s) must travel together on the same itinerary. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18), unless the child or legal ward of winner and must sign a liability/publicity release prior to issuance of travel documents. If guest is child or legal ward of winner, winner must sign and return release on behalf of such child or legal ward. Travel must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Travel is subject to availability. Certain blackout dates and travel restrictions may apply. All federal, state and local taxes and all other costs associated with prize acceptance and use not specified herein as being provided, including meals, souvenirs, and gratuities, are the sole responsibility of the winners.
SPORTS, MOVIE OR OTHER TICKET PRIZES: Event, date and approximate retail value to be provided on the individual contest page. Tickets are subject to certain terms and conditions as specified thereon. Seat locations will be determined by Sponsor. Winner and guest must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of prize.
COMBINED TRAVEL AND TICKET PRIZES: In the event Sponsor is unable to provide tickets or admission to event, no compensation or substitution will be provided in lieu thereof; however, remainder of prize package will be awarded and Sponsor will have no further obligation to winner.
CAR PRIZES: Specific Model and Manufacturer’s Suggested Retail Price (“MSRP”) to be provided on the individual contest page. All prize details, including color and options, will be determined solely by Sponsor in its sole discretion. Winners must take delivery of vehicle from the dealership designated by Sponsor, or as otherwise instructed by Sponsor. All costs and expenses related to prize acceptance and use not specified herein as being awarded are the responsibility of winner, including, but not limited to, all federal state and local taxes (including income taxes), title, insurance, license and registration fees. Winners will be required to present a valid U.S. driver’s license and proof of appropriate insurance as a condition of receiving prize. Open to winners in the U.S. only. Winners outside the U.S. will receive the actual retail value of the vehicle in cash.
GIFT CARD PRIZES: Gift card amount and issuer to be specified on the individual contest page. Gift card is subject to certain terms and conditions as specified by issuer.
4. Disclaimer of Liability and Release
Entrants, by participating, agree, to the extent permitted in the entrant’s country, that BADDIES ONLY and its affiliates and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, "Released Parties") will have no liability whatever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in the Giveaways.
Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, garbled, illegible or postage-due mail, entries or email; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind, whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Giveaways, including errors or difficulties which may occur in connection with the administration of the Giveaway, the processing of entries, the announcement of the prizes or in any Giveaway-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by other entrants or site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Giveaways. Released Parties are not responsible for injury or damage to participants’ or to any other person's computer related to or resulting from participating in this Giveaway or downloading materials from or use of the website.
5. Miscellaneous Provisions.
Persons who tamper with or abuse any aspect of the Giveaways or website or who are in violation of these Rules, as solely determined by BADDIES ONLY, will be disqualified and all associated entries will be void. Should any portion of the Giveaway be, in BADDIES ONLY’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the BADDIES ONLY, corrupt or impair the administration, security, fairness or proper play, or submission of entries, BADDIES ONLY reserves the right at its sole discretion to suspend, modify or terminate the Giveaway and, if terminated, at its discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by BADDIES ONLY.
In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. CAUTION: ANY ATTEMPT TO DAMAGE THE BADDIES ONLY SITE OR SERVICE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, SHOULD SUCH AN ATTEMPT BE MADE, BADDIES ONLY WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
